WR Specialists, LLC (“WRS”) is strongly committed to transparency, and we want you (“you” or “your”) to understand how we collect, use, disclose, and protect your Personal Data (as defined below), as well as the rights and choices you have with respect to your Personal Data and how you can contact us to get answers to your questions.

This Privacy Notice (“Privacy Notice” or “Notice”) applies to information we collect in various contexts, both online and offline, including when you: (i) access, use, or otherwise interact with our applications, devices, equipment, technologies, solutions, and features in connection with Cold Compression Therapy (“CCT”) and, if applicable, Remote Therapy Monitoring (“RTM”) services offered through WRS (collectively, the “Services”); and (ii) submit information to us, such as on the “Contact Us” page of our website (https://www.wrs.group/wrs/), through the Services, or in email or other electronic communications between you and us (whether by telephone or through other means). This Privacy Notice also applies to information we collect automatically as you use our Services and from third parties.

CCT. Your healthcare provider has prescribed CCT as part of your treatment. CCT devices provide cold and compression therapy that may help reduce pain, swelling, and inflammation during recovery. By accepting and using the CCT equipment provided through WRS, you acknowledge that you have received instructions for the use of the therapy device and agree to use the equipment as directed by your healthcare provider.

RTM. As part of your prescribed CCT program, you may participate in RTM, in which case WRS uses a connected device and a mobile application to collect certain therapy-related information during your use of the CCT device to help support therapy monitoring and care coordination. Please review this Privacy Notice and our Consumer Health Data Privacy Policy for further details regarding RTM, including information on how to participate and opt-out of RTM as well as our practices for collecting, using, maintaining, protecting, and disclosing information we collect through your participation in RTM, and your rights and choices with respect to such information. RTM is intended to support therapy tracking and communication with your care team. It does not replace medical care or emergency services. We collect two basic types of information about you when you provide it to us, access or use our Services, or otherwise communicate with us: Personal Data and non-Personal Data.

We collect the following types of Personal Data directly from you when you use or interact with our Services or communicate with us: (i) name; (ii) date of birth; (iii) postal address; (iv) telephone number; (v) email address; (vi) medical information, which may include prescription information or details of a medical condition and/or disability; (vii) workers’ compensation claim number (if you are a workers’ compensation patient who uses our Services, this information is used solely for claims processing); and (viii) gender.

Information We Collect Through Automatic Data Collection Technologies

WRS’ Equipment

If you use our Services as a participant in RTM, we use a connected device and a mobile application to collect certain therapy-related information during your use of the CCT device. Once RTM has been implemented onto your mobile device, an application from your mobile phone will connect to a smart plug, which is a device that plugs into a standard wall outlet and allows you to control the power flow to your CCT device remotely. It may be equipped with operations and telematics hardware and software (“Telematics”) that are capable of transmitting information about the CCT device, including their condition and operational data via Bluetooth signals. The information we automatically collect via the Telematics system may include the following types of Personal Data and/or Non-Personal Data or we may maintain it or associate it with Personal Data or Non-Personal Data we collect in other ways:

WRS’ Website

As you navigate through and interact with our website, we may use cookies to collect limited, Personal Data and/or non-Personal Data about your visit to our website which helps us provide our website to you. Cookies (or browser cookies) are small text files that may be placed on your computer or device by us or our service providers and partners when you visit our website. All of our cookies are managed by us (first-party cookies) rather than by third parties that we do not control (third-party cookies). A cookie assigns a unique identifier to your web browser or device and may enable us to recognize you as the same user who has used the website and relate your use of the website to other information about you, such as your usage information.

Information We Collect from Third Parties

We may also collect certain Personal Data about you from third parties, such as your health care provider who prescribed CCT as part of your treatment, an ordering physician, or another workforce member at your prescriber’s office. This information may include your name, diagnostic code, and possibly your Social Security number (if you are a workers’ comp patient, your carrier may require us to provide it with your SSN to identify you in their system).

DO NOT TRACK (“DNT”) SIGNAL

Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. Except as otherwise described in this Privacy Notice (including any jurisdiction-specific addendum) with respect to legally required browser based opt outs, we do not recognize or respond to browser-initiated DNT signals, as there currently is no accepted standard for how a website or online service should respond to this signal.

Data Security

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. To the extent we have given you (or where you have chosen) a password for access to certain parts of our Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Children Under the Age of 13

Our website is not intended for – and we do not knowingly collect any Personal Data from – children under the age of 13. If we learn we have collected or received Personal Data from a child under 13 without verification of parental consent, we will delete that information. Consent to Processing of Personal Data in the United States

In order to provide our Services to you, we may store and process your Personal Data outside of the country where you reside or are located, including to countries that may not or do not provide an equivalent level of protection for your Personal Data. Your Personal Data may be processed and stored in the United States and federal, state, and local governments, courts, or law enforcement or regulatory agencies in the United States may be able to obtain disclosure of your information through the laws of the United States. U.S. State Privacy Supplement

Introduction

This WRS State Privacy Supplement (“U.S. State Privacy Supplement” or “Supplement”) is only applicable to residents of Connecticut, Nebraska, and Texas (“you” or “your”) and supplements the information contained in our Privacy Notice.

We have adopted this Supplement to comply with the Connecticut Data Privacy Act (“CTDPA”), Nebraska Data Privacy Act (“NDPA”) and the Texas Data Privacy and Security Act (“TDPSA”) (collectively, the “Relevant State Privacy Laws”). Unless otherwise expressly stated, all terms in this Supplement have the same meaning as defined in our Privacy Notice or as otherwise defined by Relevant State Privacy Laws.

Scope

Some Personal Data we collect from you may not be covered by this U.S. State Privacy Supplement. The Relevant State Privacy Laws include certain exemptions that do not apply to our collection and processing of your Personal Data. It is possible that not all Personal Data we collect from or about you is fully covered by the Relevant State Privacy Laws. Accordingly, this U.S. State Privacy Supplement and/or the privacy rights set out herein may not apply to you or to all of your Personal Data. For example, any Personal Data we have from residents of Connecticut, Nebraska, and Texas in their capacity as (i) prospective, current, or former employees, personnel, or independent contractors of WRS, or (ii) individual representatives of corporate customers or clients of WRS in connection with a business-to-business transaction or related communication involving WRS is not covered by this Supplement.

WRS discloses your Personal Data to the same categories of recipients and for the same purposes as described in our Privacy Notice.

In addition, we do not (i) “sell” your Personal Data for either monetary or other valuable consideration, (ii) process your Personal Data for targeted advertising purposes, or (iii) use your Personal Data with any automated processing, including to evaluate, analyze, or predict personal aspects related to your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements (“profiling”), which may produce a legal effect concerning you or similarly significantly affect you.

Verifying Your Requests

We may need additional information to authenticate your request. We may need to obtain additional information about you that we do not already have to be able to authenticate your request. If you provide us with new Personal Data that we do not already have about you, we will use it solely for the purpose of authenticating your request. We will let you know if we need more information from you to authenticate your request. Please reply to our requests promptly.

We will communicate with you about your requests via email. We will use the email address you provided when submitting your request.

Responding to Your Requests

We aim to promptly authenticate and respond to your requests within 45 days of receipt but may require a total of up to 90 days to respond to your requests. If we require additional time beyond the initial 45 days after we receive your request, we will let you know within the first 45 days.

We do not ordinarily charge a fee for our response to your requests. However, we may do so to the extent your request(s) are excessive, repetitive, or manifestly unfounded. If we determine that charging a fee is warranted, as permitted by the Relevant State Laws, we will let you know and will provide you with an estimate of the associated costs of responding to your request(s).

If we determine that we cannot or will not take the action that you requested, we will let you know. We will inform you of our reasons for not taking action and of any rights you may have to appeal the decision. We will respond to your requests via email. We will contact you at the email address you provided when submitting your request(s).

Appeals Process

If applicable under Relevant State Privacy Laws, you may appeal a refusal by us to take action on your request to exercise any of the above rights within a reasonable period of time after we provide you with notice of such refusal by contacting us at the Contact Information listed below. Within 45 days after we receive your appeal, we will inform you in writing of any action taken or not taken in response to your appeal, including any explanations for the reasons for the decision. If your appeal is denied, you may lodge a complaint with your State Attorney General through their official website.

Changes to Our U.S. State Privacy Supplement

From time to time, WRS may update or revise this U.S. State Privacy Supplement at its discretion and at any time. If there are changes to the terms of this U.S. State Privacy Supplement, an updated Supplement will be posted to our website, along with the updated Supplement’s effective date. Your continued use of our Services following the posting of changes constitutes your acceptance of such changes.
